This policy explains how Easy Inflatables manages custom-built orders, deposits, final payments, ownership, delivery, cancellations, refunds, returns, warranty claims and Australian Consumer Law rights.
Most Easy Inflatables boats, kayaks, outboards and selected marine products are custom-built, imported, specially ordered or allocated specifically for each customer. Once production, supplier commitment, factory scheduling, material allocation, freight planning or fulfilment has commenced, deposits are generally non-refundable except where a remedy is required under Australian Consumer Law.
Many Easy Inflatables products are not standard shelf-stock items. They may be custom-built, ordered from a manufacturer, allocated from a production run, imported, modified, packaged or freight-planned specifically for the customer.
Payment of a deposit does not transfer ownership, title, possession rights or registration rights in the goods. Easy Inflatables retains ownership until the full purchase price and any agreed charges have been paid in full and cleared.
If the customer does not pay the final balance after being notified that the order is complete or ready, Easy Inflatables may treat the order as being in default.
If goods arrive damaged, defective or fail to meet applicable consumer guarantees, Easy Inflatables will assess the issue and provide an appropriate remedy where required by Australian Consumer Law. Depending on the circumstances, this may include repair, replacement, refund, compensation or another remedy required by law.
Easy Inflatables is not responsible for delay, suspension, increased freight cost or inability to fulfil an order where caused by events outside our reasonable control, including supplier delays, factory shutdowns, customs intervention, port closures, freight disruption, government action, natural disasters, material shortages, industrial action or major supply chain interruptions.
Nothing in this policy excludes, restricts or modifies any rights or remedies that cannot be excluded under Australian Consumer Law.
Our goods come with guarantees that cannot be excluded under Australian Consumer Law. Customers are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. Customers are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
