This policy explains how Easy Inflatables manages custom-built orders, deposits, final payments, ownership, delivery, cancellations, refunds, returns, warranty claims and Australian Consumer Law rights. It should be read together with our Warranty Policy and our standard Terms and Conditions of Trade.

1. Summary

Most Easy Inflatables boats, outboards and selected marine products are custom-built, imported or specifically allocated to each customer. Production, materials, factory capacity, international freight, customs clearance, local handling and delivery are committed to fulfilling each individual order.

  • Custom orders are built, ordered or allocated specifically for the customer.
  • Deposits secure production, supplier and fulfilment costs and are non-refundable.
  • Ownership transfers only after full, cleared payment.
  • Consumer rights under Australian Consumer Law are not excluded by this policy.

2. Custom-built orders and deposits

Many Easy Inflatables products are not shelf-stock items. They are custom-built, ordered from a manufacturer, allocated from a production run, imported, configured or freight-planned specifically for the customer.

  • Standard custom production orders require a 50% deposit unless otherwise agreed in writing.
  • The deposit secures production capacity, supplier allocation, factory scheduling, materials, administration and fulfilment.
  • Once the order is accepted, specified, allocated, produced, freight-booked or otherwise committed to the customer's chosen specification, the deposit is non-refundable and the customer remains liable for the full contract price, to the maximum extent permitted by law.
  • A custom-built boat is not returnable stock. Colour, layout, fittings, packages, HIN allocation, freight planning and production capacity are committed for that customer and cannot simply be unwound because the customer changes their mind or later decides not to proceed.

3. Ownership, final payment and PPSA security interest

Payment of a deposit does not transfer ownership, title, possession or registration rights in the goods. Easy Inflatables retains ownership until the full purchase price and any agreed charges have been paid in full and cleared.

  • The final balance is due within 7 business days after Easy Inflatables notifies the customer that the order is complete or ready for dispatch, collection or release.
  • Goods will not be dispatched, collected, delivered or released until full cleared payment has been received.
  • Registration paperwork, HIN details, compliance documents, tax invoices, accessories and related goods may be withheld until payment clears.
  • Ownership transfers only after Easy Inflatables receives full cleared payment.

Security interest โ€” Personal Property Securities Act 2009 (Cth). The retention of title described above creates a Purchase Money Security Interest (PMSI) in favour of Easy Inflatables over the goods supplied, including any proceeds. By placing an order, the customer:

  1. acknowledges that Easy Inflatables holds a PMSI under the Personal Property Securities Act 2009 (Cth) (PPSA) until full payment is received in cleared funds;
  2. consents to Easy Inflatables registering its security interest on the Personal Property Securities Register (PPSR) and waives any right to receive notice of that registration under the PPSA;
  3. agrees to do all things reasonably required (including signing documents) to enable registration, maintenance or enforcement of that security interest; and
  4. grants Easy Inflatables, its agents and representatives an irrevocable licence to enter any premises where the goods are reasonably believed to be located, to inspect or retake possession of the goods if the balance is not paid in accordance with this policy.

To the extent permitted by the PPSA, the parties contract out of sections 95, 118, 121(4), 130, 132(3)(d), 132(4), 135, 142 and 143 of the PPSA, and the customer waives any right to receive any notice, statement, verification or other document otherwise required under those sections.


4. Automatic balance payment via Stripe

Where a 50% deposit has been paid, the customer's card details are securely tokenised by Stripe at the time of deposit. Easy Inflatables does not store card numbers. By placing a deposit order, the customer authorises Easy Inflatables and Stripe to automatically charge the remaining 50% balance to the same card prior to dispatch.

  • The balance is charged automatically shortly before the order is dispatched, collected or released.
  • A tax invoice and payment receipt are emailed once the balance payment is processed.
  • If the saved card is declined, expired, cancelled or otherwise unable to be charged, Easy Inflatables will email the customer a tax invoice for the outstanding balance.
  • The customer then has up to 7 business days from the date of that invoice to pay the outstanding balance in cleared funds.
  • If the balance remains unpaid after 7 business days, the order may be treated as being in default โ€” see Section 7.

4A. WavePay โ€” 4 fortnightly payments (Pay-in-4)

WavePay is our in-house Pay-in-4 plan, available on boats and boat packages only (not accessories or outboards). It is processed and underwritten by Stripe; Easy Inflatables never stores raw card numbers.

  • The total boat price is split into 4 equal fortnightly payments (every 14 days).
  • Instalment 1 is charged immediately when the customer saves their card. Instalments 2, 3 and 4 are automatically charged to the same card every 14 days.
  • Instalments 1 and 2 together constitute the non-refundable deposit (50% of the boat price). The boat enters the build queue as soon as instalment 2 has cleared, so production starts while instalments 3 and 4 are still scheduled. The boat is completed and dispatched only after the 4th instalment has cleared. Title and risk pass under the same rules as a full-payment order โ€” see Section 3.
  • A WavePay tax invoice / receipt is emailed after every successful instalment, and a final completion notice is sent when the 4th payment clears.
  • If a scheduled instalment is declined, Stripe automatically retries with Smart Retries. If the card still cannot be charged, the plan is paused, the customer is notified by email, and they have 7 business days to update the card or pay the outstanding balance in cleared funds before the order is treated as being in default (see Section 7).
  • WavePay is not a credit product and not a layby agreement (see Section 6). There are no interest charges, no merchant fees passed to the customer, and no late fees beyond the cost-recovery and admin fees set out in these terms.
  • The customer may prepay any remaining instalments at any time by contacting sales@easyinflatables.com.au โ€” early payment simply releases the boat to the build queue sooner.
  • WavePay plans are non-transferable and tied to the original ordering customer. Once a WavePay plan begins, all instalments are non-refundable โ€” this covers the non-refundable deposit and the custom build. Cancellation of a WavePay order is treated the same as cancellation of any other custom-built boat order once production has been committed (see Sections 2 and 8).

5. Accessories โ€” paid in full

The 50% deposit option applies only to custom-built boats and boat packages. Accessories, spare parts, add-ons, outboard oil, fuel tanks, covers, bags and similar items are paid in full at the time of order, regardless of whether they are purchased on their own or alongside a boat.


6. Not a layby agreement

A custom-built supply order with a 50% deposit and an automatic balance charge is not a "layby agreement" within the meaning of sections 72โ€“78 of the Australian Consumer Law.

  • The goods are not held in stock pending instalment payments. They are custom-built, allocated or imported specifically for the customer.
  • Payment is made in two parts (deposit and pre-dispatch balance), not by three or more progressive instalments over time.
  • The customer takes delivery once the goods are produced and the balance has cleared; the goods are not "set aside" for the customer at a finished state for an indefinite period.

For the avoidance of doubt, the parties agree that this policy is not intended to create, and does not create, a layby agreement under the ACL.


7. Customer default

If the customer does not pay the final balance after being notified that the order is complete or ready, Easy Inflatables may treat the order as being in default. The unpaid balance remains a debt payable by the customer, and Easy Inflatables may:

  • withhold dispatch, cancel the order, reallocate the production slot, return the goods to stock, or resell the goods;
  • enforce its PPSA security interest under Section 3 to retake possession of the goods;
  • retain part or all of the deposit to recover production, supplier, factory, material, freight, storage, resale and administration costs;
  • apply reasonable storage, handling or administration charges where goods remain unpaid, uncollected, unreleased or undeliverable for reasons attributable to the customer;
  • recover any reasonable shortfall or loss caused by the customer default to the extent permitted by law.

8. Cancellations, refunds and returns

  • Change-of-mind cancellations are not accepted once the order has been accepted, specified, allocated, processed, production-booked, supplier-committed, freight-booked, built, dispatched or put in transit.
  • Custom-built boats, outboards and special-order products are not cancellable or refundable once ordered or committed for the customer's specification, except where a non-excludable law requires a remedy.
  • Return requests must be approved by Easy Inflatables in writing before goods are sent back.
  • Returned goods must generally be unused, uninstalled, uninflated, unassembled, complete, undamaged and in original condition.
  • Unless required otherwise by Australian Consumer Law (see Section 11), the customer is responsible for return freight, packaging, insurance and related return costs.

9. Delivery, freight and customs

  • Delivery and production timeframes are estimates only and are not guaranteed.
  • Delays may occur because of manufacturing schedules, customs, port congestion, freight providers, couriers, warehouse handling, suppliers or international shipping conditions.
  • Delays outside Easy Inflatables' reasonable control do not automatically create a right to cancellation, refund or compensation unless required by law.
  • Customers must provide accurate delivery details. PO Boxes are not suitable for large marine freight.
  • Additional freight, remote-area, redelivery, failed-delivery, storage or handling charges may apply where caused by customer error, inaccessibility, incorrect details or delayed customer response.
  • A flat AUD $600 remote-area sea-freight surcharge is applied automatically by the checkout from your delivery postcode (NT, Far-North QLD, outback SA, remote WA, regional TAS and all ACT postcodes). Express Air Delivery is unaffected โ€” it stays a flat A$600 fully landed to every Australian postcode with no remote-zone add-on. Entering an incorrect or non-remote postcode to avoid the surcharge does not waive it โ€” any shortfall is payable before dispatch.
  • DDP tracking is limited โ€” please read. Free DDP (Delivered Duty Paid) sea-freight shipments are handled end-to-end by independent overseas freight-forwarding agents in Hong Kong, their ocean carriers, Australian customs brokers and Australian last-mile couriers. These forwarding agents are appointed by the manufacturers, not by Easy Inflatables. Easy Inflatables is not the carrier and does not receive live tracking, GPS, vessel position, container-level scans or daily milestone updates on DDP shipments. The reference numbers used throughout the shipment are internal to the freight-forwarding agents and are used by those agents to coordinate the movement of the freight from origin through to final delivery. Any references to airline tracking numbers cannot be used to track the shipments publicly. The same limits apply to any existing air-freight orders that are still in transit (orders placed before our 1 June 2026 move to DDP sea freight and not yet delivered) โ€” the same Hong Kong-based forwarding agents, appointed by the manufacturers, handle those shipments through the airline, customs broker and Australian last-mile chain, and airline waybill numbers on those bookings cannot be used to track the shipment publicly. An Australian connote number is typically only generated late in the chain, once the local courier has accepted the carton for final delivery, and may update only on the day of delivery. We will pass on meaningful updates we do receive (factory dispatch, sailing window, Australian arrival, final-leg courier reference) but we cannot provide tracking information we do not hold, and the forwarding agent's internal systems are largely in Chinese and not built for customer self-service. By checking out without selecting the optional DHL Express Air-Freight upgrade, you are choosing the free DDP sea-freight service and accepting these tracking limitations as the agreed information service for your shipment โ€” this is the trade-off for free shipping. We strongly recommend the DHL Express Air-Freight upgrade if visibility matters to you: you get a live DHL waybill with door-to-door tracking from warehouse pickup, typical 7โ€“14 business day delivery, express priority customs clearance by DHL's in-house brokers, a dedicated DHL customer-service line, signature on delivery, full air-freight insurance and email/SMS milestone alerts at every scan. Once a shipment has been booked under free DDP, the DHL Express upgrade cannot be retro-fitted to that shipment. Nothing in this paragraph excludes or limits any right or remedy you have under the Australian Consumer Law โ€” it explains what tracking service is and isn't included with free DDP sea freight. See Shipping Policy ยง8A and Terms ยง9 for the full clause.

10. Inspection, damage and missing items

  • Customers should inspect goods as soon as reasonably possible after delivery.
  • Visible transit damage, missing items, shortages or other delivery issues should be reported in writing within 48 hours of delivery.
  • Concealed damage (damage not visible on initial inspection because the carton, pallet wrap or factory packaging appeared intact) must be reported in writing with photos within 7 days of delivery.
  • Please provide clear photos of the packaging, shipping label, pallet, carton, damaged area and affected goods.
  • Easy Inflatables will assess legitimate delivery claims and respond in accordance with Australian Consumer Law.

11. Return freight for major failures

Section 263 of the Australian Consumer Law deals with return of rejected goods. Easy Inflatables confirms that, where the ACL applies:

  • For goods that can be returned without significant cost, the customer must return the goods at Easy Inflatables' expense where a valid rejection is made for a major failure.
  • For goods that cannot be returned, removed or transported without significant cost because of their nature, size, weight or method of attachment (which includes inflatable boats, catamarans, outboard engines and most marine packages), Easy Inflatables will collect the goods, or pay reasonable return freight, at its expense.
  • The customer is not required to bear return freight or removal costs where the ACL requires Easy Inflatables to bear them.

For non-major failures, return shipping is generally arranged in accordance with Section 8.


12. Service guarantees โ€” delivery and installation

Where Easy Inflatables supplies a service (including delivery booking, freight coordination, on-site delivery and any fit-out or installation service), that service is provided with the consumer guarantees set out in Part 3-2 Division 1 of the Australian Consumer Law, including:

  • the guarantee of due care and skill;
  • the guarantee of fitness for any disclosed purpose;
  • the guarantee that the service will be supplied within a reasonable time where no time is fixed.

These guarantees apply alongside the goods-related guarantees and cannot be excluded.


13. Warranty claims

If goods arrive damaged or defective, or fail to meet applicable consumer guarantees, Easy Inflatables will assess the issue under the Warranty Policy and provide an appropriate remedy where required by Australian Consumer Law. Where the law allows, the remedy will be repair or replacement of the affected product or component; refunds are issued only where Australian Consumer Law requires them.

Return of the faulty / replaced component (advance replacement). Where Easy Inflatables ships a replacement component (for example a tube, air-deck, floor, valve assembly, pump, seat, transom fitting, cover or accessory) to the customer before the faulty item is returned, the replacement is supplied on the express condition that the faulty item is returned to Easy Inflatables within 14 days of the customer receiving the replacement. Easy Inflatables will provide a return address and, where the ACL requires (see Section 11), will pay or reimburse reasonable return freight โ€” return freight by standard Australia Post for a component of this kind is typically $35โ€“$45.

If the customer does not return the faulty component within 14 days, or refuses to return it, or returns it in a condition that prevents warranty assessment (for example deliberately destroyed, dismantled beyond inspection, or with the serial / batch markings removed):

  1. the warranty claim in respect of that component is withdrawn;
  2. the replacement component is deemed to have been supplied as a normal retail sale, not as a warranty replacement;
  3. the customer becomes liable to pay the current retail price of the replacement component, plus freight, GST and any payment-processing fees, as a debt due and payable to Easy Inflatables on the date of the next invoice; and
  4. that amount may be charged to the card on file (the same card used for the original order or deposit) under the customer's existing payment authority, or invoiced separately for payment within 7 days.

The retail price of a replacement major component (for example a full tube set, complete air-deck or replacement hull section) commonly exceeds AUD $1,000 and in some cases is materially higher. By accepting an advance replacement, the customer acknowledges and agrees to these terms.

This clause does not exclude any non-excludable right of a consumer under the Australian Consumer Law; it sets out how the parties deal with the return of the faulty item where Easy Inflatables has elected to ship the replacement first as a goodwill measure.


14. Choice of remedy on custom-built boats

Easy Inflatables boats are custom-built, made-to-order marine products manufactured, allocated, imported and shipped specifically for each customer. They are not standard returnable shelf-stock and cannot be re-sold as new once delivered.

Once a customer orders a custom-built boat to a chosen specification, the customer is buying that boat. The customer remains responsible for paying the full agreed price. A later cancellation request, refusal to pay the balance, refusal to accept delivery, change of mind, or dissatisfaction with a repairable component issue does not convert the order into a refundable sale.

Under Australian Consumer Law, where a fault is not a major failure, the supplier has the right to choose the remedy โ€” by way of repair, replacement of the affected part, or replacement of the product, within a reasonable time. A refund is not the default remedy for a non-major fault.

Order commitment and delivery are the cut-offs for refunds. Once a boat order has been accepted and committed to the customer's specification, payments are non-refundable except where a non-excludable law requires a remedy. Once a boat has been delivered to the customer's nominated address, depot, freight forwarder, agent or representative โ€” or collected by the customer or their carrier โ€” no refund is available for any fault that is not a genuine "major failure" under the Australian Consumer Law, regardless of whether the boat is subsequently:

  • registered or unregistered with a maritime authority,
  • coated, painted, vinyl-wrapped, antifouled or otherwise surface-treated,
  • modified, fitted-out, drilled, repowered or fitted with electronics or accessories,
  • launched, used, trialled, towed or stored,
  • inflated, deflated, packed away or left assembled.

Any subsequent component fault โ€” including air-deck failure, valve leak, seam leak, tube leak, fitting failure, pump fault or accessory issue โ€” is a warranty matter to be resolved by repair or replacement of the affected component under the Warranty Policy. Component faults do not entitle the customer to reject the whole boat where the affected component can be repaired or replaced within a reasonable time.

Refunds are not available for:

  • component-level faults on a delivered boat (these are warranty matters);
  • boats that have been delivered, registered, coated, modified, fitted-out, repowered or used;
  • cosmetic, minor or repairable issues that do not amount to a "major failure" under the ACL;
  • change of mind, buyer's remorse, finance changes, insurance changes, storage issues, partner approval, third-party opinions or any change in personal circumstances;
  • disagreement with a remedy lawfully elected by Easy Inflatables;
  • refund requests made before Easy Inflatables has had a reasonable opportunity to inspect, assess, repair or replace the issue.
  • orders where the customer refuses to pay the balance or refuses delivery of a conforming custom-built boat.

15. When a refund may be available

A refund on a custom-built boat will only be issued where required by Australian Consumer Law. In practical terms, the issue must be serious enough that repair or replacement is not an adequate remedy โ€” for example, a genuine major structural failure of the hull that cannot be repaired or replaced within a reasonable time. Each of the following must be satisfied:

  • the boat suffers a genuine "major failure" as defined by the ACL; and
  • Easy Inflatables has been given a reasonable opportunity to inspect, assess, repair and/or replace the boat or affected component; and
  • the boat has not been registered, coated, modified, surface-treated, fitted-out, repowered or used in a way that prevents normal assessment, repair or replacement; and
  • repair or replacement cannot be carried out within a reasonable time.

A component fault that can be repaired or replaced โ€” including an air-deck, floor, valve, fitting, pump, seat, accessory or isolated seam/tube issue โ€” is not a "major failure" of the boat and does not, on its own, entitle the customer to a refund of the boat.

For clarity, the following are normally repair or replacement matters, not refund matters: a replaceable air-deck floor, valve, pump, seat, oar, bag, bimini, accessory, fitting, patchable puncture, isolated seam issue, cosmetic mark, freight scuff, loose fitting, missing accessory, or other issue that can be fixed by supplying a part, repairing the affected area, or replacing the affected component.

Whole-boat replacement may be offered at Easy Inflatables' discretion where a hull is independently assessed as not economically repairable. Whole-boat replacement is a discretionary remedy and not a customer entitlement except where the ACL strictly requires it.


16. Chargebacks and payment disputes

Warranty issues are not valid grounds for a chargeback under any card scheme, BNPL or finance provider's dispute rules. Card scheme rules (Visa, Mastercard, American Express), PayPal, Afterpay, Zip, Klarna and finance providers all require the cardholder to first give the merchant a reasonable opportunity to remedy a defect before a "not as described" dispute can succeed. A covered warranty matter that Easy Inflatables has offered to remedy is not "goods not as described" โ€” it is a warranty claim and must be raised through the Warranty Policy.

Reasonable opportunity to remedy. By placing an order, paying a deposit or balance, and/or accepting delivery of the boat, the customer agrees that they will not initiate or pursue any credit-card chargeback, debit-card chargeback, PayPal dispute, Stripe dispute, BNPL reversal, bank-transfer reversal, direct-debit reversal, finance-company reversal or any other payment-reversal proceeding without first giving Easy Inflatables a reasonable opportunity (being not less than 14 days from written notice of the issue) to assess and remedy the issue under the Warranty Policy. This restriction applies to:

  • a warranty issue (including air-deck, floor, seam, valve, fitting or accessory matters);
  • change of mind, buyer's remorse, finance, insurance, partner, storage or personal circumstances;
  • any matter that does not amount to a "major failure" under the ACL that Easy Inflatables has offered to remedy.

Where a chargeback, dispute or reversal is lodged in breach of this clause, Easy Inflatables will:

  1. Defend the dispute in full with the order, deposit and balance receipts, build specification, freight and customs paperwork, proof of delivery, customer correspondence, the Warranty Policy and a written record of every remedy offered.
  2. Recover the disputed amount as a debt, together with chargeback fees, currency-conversion losses, bank and processor fees, administration costs, freight and storage costs, debt-collection fees and reasonable legal costs (including, to the extent permitted by law, on an indemnity basis).
  3. Recover the goods under its PPSA security interest where ownership has reverted to Easy Inflatables as a result of a wrongful payment reversal, including by court order if required.
  4. Refer the matter to the relevant authorities and credit-reporting agencies where conduct is unlawful, and decline future supply.

Customers with a genuine warranty concern are asked to contact Easy Inflatables first so the matter can be assessed and resolved under the Warranty Policy. The warranty process is the correct and quickest path to a remedy.

This clause does not exclude any non-excludable right of a consumer under the Australian Consumer Law or applicable card-scheme rules.


17. Proof of transaction and tax invoices

In accordance with section 100 of the Australian Consumer Law, Easy Inflatables will provide a proof of transaction for every purchase. A tax invoice or receipt is emailed automatically once payment is processed and is also available on request to sales@easyinflatables.com.au.


18. Product recalls and safety notices

If a safety issue, voluntary recall or mandatory recall is announced in relation to any product supplied by Easy Inflatables:

  1. Easy Inflatables will notify affected customers using the contact details on file as soon as reasonably practicable.
  2. The notice will set out the issue, the affected models or serial / HIN numbers, the action the customer should take, and the remedy being offered (which may include repair, replacement, rework, or a refund only where required by law).
  3. Customers must follow the safety instructions in the recall notice and cease using the affected product until the remedy has been carried out.
  4. Easy Inflatables will report the recall to the Australian Competition and Consumer Commission (ACCC) where required by section 128 of the ACL.

Customers are asked to keep their contact details up to date by emailing sales@easyinflatables.com.au so recall and safety notices reach them quickly.


19. Customer acknowledgement

By placing a deposit or full payment, and again by accepting delivery of the boat, the customer acknowledges and agrees that:

  1. The boat is a custom-built, personally ordered marine product and not standard returnable stock.
  2. Production, materials, factory capacity, international freight, customs clearance, local handling and delivery have been irreversibly committed to fulfilling the customer's specific order.
  3. The deposit is non-refundable and the customer remains liable for the full agreed price once the order is accepted or committed to their specification, subject only to non-excludable law.
  4. Once delivered, the boat cannot be refunded for any non-major fault, regardless of registration status, coating, modification, fit-out or use.
  5. Component faults covered by warranty will be remedied by repair or replacement of that component, not by refund of the boat.
  6. A refund of the boat is reserved for circumstances where Australian Consumer Law requires it, such as an established major structural failure that cannot be repaired or replaced within a reasonable time.
  7. Chargebacks, payment disputes and finance reversals will not be used to raise warranty matters, balance-payment refusals or change-of-mind matters and, where lodged in breach of this policy, will be defended in full and recovered as a debt together with associated costs.

This clause does not exclude, restrict or modify any non-excludable rights under Australian Consumer Law; it sets out how those rights apply in the context of custom-built marine products.


20. Events outside our control

Easy Inflatables is not responsible for delay, suspension, increased freight cost or inability to fulfil an order where caused by events outside our reasonable control, including supplier delays, factory shutdowns, customs intervention, port closures, freight disruption, government action, natural disasters, material shortages, industrial action or major supply-chain interruptions.


21. Non-consumer and commercial purchases

Where the goods or services are not of a kind ordinarily acquired for personal, domestic or household use or consumption, or where the customer is acquiring them for the purpose of re-supply, commercial hire, charter, instructional, racing, rescue or other commercial use, the customer is not a "consumer" for the purposes of certain ACL guarantees, or the consumer guarantee threshold under section 3 of the ACL does not apply.

To the extent permitted by section 64A of the ACL, and where the goods or services are not of a kind ordinarily acquired for personal, domestic or household use or consumption, Easy Inflatables' liability for failure to comply with a consumer guarantee is limited (at Easy Inflatables' option) to:

  • in the case of goods: the replacement of the goods, the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment of the cost of having the goods repaired; or
  • in the case of services: the re-supply of the services or the payment of the cost of having the services supplied again.

This clause does not apply to any guarantee that cannot be excluded, restricted or modified by Easy Inflatables under the ACL.


22. Privacy of warranty and claim data

Personal information collected as part of an order, payment, delivery, warranty claim or refund is handled in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles and our Privacy Policy. Information may be shared with payment processors, freight providers, manufacturers, repairers, insurers and authorised dealers strictly for the purpose of administering the order or claim.

24. Australian Consumer Law

Nothing in this policy excludes, restricts or modifies any rights or remedies that cannot be excluded under Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under Australian Consumer Law. Customers are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. Customers are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.


25. Specific customer scenarios (anti-abuse provisions)

This section records how Easy Inflatables deals with the recurring scenarios that arise on order, delivery and warranty claims. Nothing in this section excludes, restricts or modifies any non-excludable right under the ACL โ€” it records what is not a basis for refund, replacement, free upgrade or compensation. Full corresponding clauses are at Section 28 of our Terms & Conditions of Trade.

  1. Proof of purchase and HIN. Claims require the tax invoice number and HIN / serial number. Claims will not be processed where the HIN, serial number or rating plate has been removed, altered or rendered unreadable.
  2. Non-transferable warranty. Cover is granted to the original retail purchaser only. Private sale, gift, auction sale, business sale, deceased estate transfer, repossession, insurance write-off or onward export does not transfer the Easy Inflatables warranty.
  3. Unauthorised repair, modification or fit-out. Any repair, patch, re-tube, re-coat, paint, vinyl-wrap, antifoul, drill, glue or fit-out by anyone other than Easy Inflatables or an Easy Inflatables-authorised repairer voids cover on the affected component and on any consequential damage. Third-party repair invoices are not reimbursed unless approved by us in writing before work commences.
  4. Outboard, electronics and accessory fitment. Exceeding the rated horsepower or transom weight, fitting non-marine electronics, or self-drilling the transom, hull or floor voids cover on the affected components. Damage from self-installation is not covered.
  5. Use outside design conditions. Overloading, exceeding the rated person / weight capacity, grounding, rock or oyster strike, surf-zone use, ocean racing, wake-jumping, exceeding manufacturer pressures, or exposure to chemicals, hot exhaust or fuel spill is not covered.
  6. Storage, UV and care. Damage from prolonged direct sunlight without a cover, storage while wet, mould, mildew, vermin, hot vehicle / garage storage, freezing, or use of unapproved cleaners, solvents, silicones or vinyl restorers is not covered.
  7. DIY transport, towing and relocation after delivery. Once risk has passed, damage caused while the customer transports, tows, lifts, slings, deflates, packs or stores the goods is the customer's responsibility, not a warranty matter.
  8. Commercial, hire, charter and government use. Goods sold for personal use that are subsequently put into commercial, hire, charter, instructional, rescue, racing, film/TV, government or council service cease to be covered from the date of first commercial use, unless commercial supply has been agreed and priced in writing.
  9. Loss, theft, sinking, fire, collision and insurance write-off. These are insurance matters, not warranty matters. Easy Inflatables is not liable to repair, replace or refund goods lost, written off or rendered unsalvageable for these reasons.
  10. Late notification. Warranty issues must be notified in writing within 30 days of the customer first becoming aware of them, and in any event within the warranty period. Late notification that prejudices our ability to inspect or remedy may reduce or exclude cover.
  11. Access for inspection, collection and repair. The customer must give reasonable access for inspection, collection and re-delivery. Refusal of access, repeated missed appointments or unsafe access may suspend the claim; resulting futile-attendance and storage fees are payable by the customer.
  12. Customer-caused delivery failure. Incorrect address, inaccessible address, refusal of delivery, absence at the agreed window, or failure to provide gate / building / marina access at the customer's nominated address results in redelivery, depot storage, demurrage and rebooking charges payable by the customer.
  13. Free upgrade demands. A request for a free upgrade to a newer model, larger size, different colour or higher specification is not a remedy under the ACL where the original goods can be repaired or the affected component replaced within a reasonable time.
  14. Consequential loss (loaner boats, accommodation, lost holidays, lost charter income). Subject to non-excludable ACL rights, Easy Inflatables is not liable for loaner-boat costs, hire-boat costs, accommodation, travel rebooking, lost holiday value, lost fishing trips, tournament entry fees, lost charter or hire income, or similar consequential loss arising from a delivery delay or warranty repair.
  15. Loaner items. Loaner parts remain Easy Inflatables' property and must be returned within 14 days of the claim closing. Loaner items not returned, or returned damaged beyond fair wear and tear, are charged at full retail price plus freight and may be charged to the card on file.
  16. Faulty component not returned (advance replacement). Where a replacement is shipped before the faulty item is returned, the faulty item must be returned within 14 days. If not, the warranty claim is withdrawn, the replacement is deemed supplied as a normal retail sale, and the retail price (often in excess of AUD $1,000) plus freight, GST and processing fees becomes payable as a debt and may be charged to the card on file (see Section 13).
  17. Repeat claims and "no fault found". Repeat claims on a component already inspected with no fault found require new evidence. Reasonable inspection, freight and handling fees apply to "no fault found" inspections, payable in advance.
  18. Evidence integrity. The goods that are subject to a claim must not be destroyed, altered, repainted, disposed of or parted out before we have had a reasonable opportunity to inspect. Photographs and videos must be original and unedited; doctored or misleading evidence may result in the claim being refused.
  19. Threats, abuse and extortion conduct. Easy Inflatables reserves the right to decline further communication or supply to any customer who threatens staff, contractors, dealers or premises; engages in abusive, intimidating or discriminatory conduct; or threatens negative reviews, social-media posts or media content in exchange for a refund, free upgrade or other commercial benefit.
  20. Defamation and false statements. False, misleading or defamatory statements about Easy Inflatables, its staff or products may result in concerns notices, take-down demands and recovery of damages and costs under defamation legislation.
  21. Recording of communications. Inbound and outbound phone, video and chat communications may be recorded for training, quality, dispute-resolution and legal purposes. Covert recordings of our staff in breach of surveillance-device legislation will not be accepted as evidence.
  22. Refund payment method. Approved refunds are paid back to the original payment method only. Refunds will not be paid to a different card, account, person or jurisdiction. Where the original method is unavailable, refund is by EFT to a verified bank account in the original customer's name on production of ID. Currency-conversion losses on foreign-card refunds are not reimbursed.
  23. No off-setting. Customers may not withhold amounts due under an order against a real or alleged claim under a different order, product, supplier, finance contract or insurance claim.
  24. Third-party finance, BNPL and insurance. Decline or withdrawal of finance, BNPL or insurance after order acceptance does not entitle the customer to a refund of the deposit or cancellation of the order. Deposit forfeiture under Sections 2, 6 and 7 applies.
  25. Sale of business, deceased estate, divorce and bankruptcy. The order and this policy continue to bind the customer's estate, trustee, executor, successor or assignee.
  26. International export and re-supply. Goods may be sold for Australian or international use where agreed in writing. The customer is responsible for destination-country registration, safety equipment, import licensing, customs, duties, taxes and any DFAT / sanctions compliance. Unapproved re-supply, trans-shipment or commercial/charter use may affect warranty coverage as set out in the Warranty Policy.
  27. See Section 26 below โ€” Lost-in-transit shipments. Where a DDP or sea-freight shipment fails to reach its destination, the rebuild-and-re-dispatch arrangement set out in Section 26 applies in place of any refund of the original purchase price.

This section does not exclude, restrict or modify any right or remedy that the customer has under the Australian Consumer Law or any other applicable consumer protection law.


26. Lost, missing or non-delivered shipments โ€” rebuild and re-dispatch by DHL

In the unlikely event that a boat goes astray, is lost in transit, or a DDP / sea-freight shipment fails to reach its destination โ€” whether on an Australian or international leg โ€” Easy Inflatables will, at its option and subject to the freight-insurance outcome, rebuild and re-dispatch a replacement boat free of charge, so the customer is not left without their order. This mirrors clause 29 of our Terms & Conditions of Trade and Section 11 of our Shipping Policy.

  • Replacement boat at no cost. The replacement boat itself is rebuilt and supplied at no cost. The customer pays only the DHL Express Air Freight cost of the replacement shipment (DDP cannot be reused because the original DDP carriage has failed).
  • DHL freight ranges. For Australian deliveries, DHL Express freight typically ranges from AUD $890 to approximately AUD $1,200 depending on location. For international deliveries (e.g. Europe, Thailand and other destinations) it is typically around USD $800, with the exact cost quoted in writing before dispatch.
  • Written quote first. We provide a written DHL quote before dispatch and will not ship the replacement until that quote is agreed and paid.
  • Insurer credit. Where the freight insurer reimburses freight, those proceeds are credited to the customer against the DHL invoice.
  • Timeframes. Rebuild lead-time is generally 10โ€“20 days depending on model and current production load, plus the 3โ€“7 business day DHL Express transit window.
  • International customers. Remain responsible for destination-country duties, taxes, brokerage and clearance on the replacement shipment.
  • No refund where rebuild offered. Loss, theft, hijack, abandonment or non-delivery of the original shipment is not a basis for refund of the original purchase price where rebuild and re-dispatch under this section has been offered.

This section does not exclude, restrict or modify any right or remedy that the customer has under the Australian Consumer Law.


Frequently asked questions

Do I own the boat after paying a deposit? No. A deposit secures production or allocation only. Ownership transfers after the full purchase price and any agreed charges have been paid in full and cleared, and Easy Inflatables holds a PPSA security interest until then.

Why is the deposit non-refundable? Because it is committed to the customer's specific boat, production slot, materials, supplier allocation, factory scheduling, freight planning, administration and fulfilment once the order commences. It is not a refundable hold fee.

When is the final balance due? Within 7 business days after Easy Inflatables confirms the order is complete or ready for dispatch, collection or release.

What happens if I do not pay the balance? Easy Inflatables may withhold dispatch, cancel the order, resell or reallocate the goods, enforce its PPSA security interest, retain the deposit and recover losses where permitted by law.

Can I cancel a custom-built order? Cancellations are not accepted once the order is accepted or committed to the customer's specification. The deposit is non-refundable, the balance remains payable when due, and a remedy is only available where required by law.

What if my goods arrive damaged? Please contact us in writing within 48 hours with clear photos of the packaging, labels and affected goods so the issue can be assessed quickly.

Who pays return freight for a major failure? Easy Inflatables โ€” see Section 11. Inflatable boats and outboards cannot be returned without significant cost, so we collect or pay return freight where the ACL requires.

Where can I read the warranty? The full warranty terms, including coverage periods, exclusions and the claim process, are set out in the Warranty Policy.


27. International orders

Easy Inflatables actively sells and ships internationally โ€” see Section 13 of the Shipping Policy for full details on freight modes, duties and country availability.

For international orders, the following adjustments apply:

  • Quote first, order second. All international orders begin with a written quote via /international-quote. The cart checkout is reserved for Australian deliveries. The quote locks in price, freight mode (DDP / DDU / DHL Express), duties treatment and ETA in your local currency.
  • Same 50% / 50% payment plan. Same deposit and Stripe balance auto-charge model as Australian orders. Sections 2โ€“4 apply equally.
  • Importer of record. On DDP orders the destination forwarding agent is the importer of record and pre-pays duties / destination taxes. On DDU orders, the customer is the importer of record and pays destination duties / taxes / brokerage on arrival.
  • No refund where rebuild offered. Section 26 (lost / non-delivered shipments โ€” rebuild and re-dispatch by DHL) applies to international shipments. Where Easy Inflatables offers to rebuild and re-dispatch under that clause, loss of the original shipment is not a basis for refund.
  • Cancellation. International custom-built orders are not cancellable once accepted, specified, allocated, supplier-committed, freight-booked or otherwise committed to the customer's order. The deposit remains non-refundable and the balance remains payable when due, except where a non-excludable law requires a remedy.
  • Returns and change of mind. Change-of-mind returns from outside Australia are at the buyer's cost (return freight, destination export charges, AU import duties on re-entry). Where a major failure under your local consumer law is established, Easy Inflatables covers return freight in line with Section 11.
  • Consumer law in your country. Australian Consumer Law applies to deliveries within Australia. For international buyers, the non-excludable consumer-rights laws of your country (e.g. EU consumer rights, UK Consumer Rights Act, NZ Consumer Guarantees Act) continue to apply to the maximum extent required by law.
  • Sanctions and export controls. We cannot supply to countries or persons subject to Australian DFAT autonomous sanctions, UN Security Council sanctions or other export-control restrictions, and reserve the right to decline any international order on these grounds.
